Terms and Conditions

These Hawkish Institutes (“we,” “us”, or “our”) Terms and Conditions (“Terms”) govern access to and usage of our services.

Individuals who access our website, register and/or make payment for any course offered by us (“our service”) are collectively referred to as “Learners”. Learners may be referred to in these Terms as “you” and “your” as applicable.

  • Acceptance of Terms

Your use of our service constitutes your agreement to follow and be bound by these Terms. You also agree to comply with all applicable laws and regulations, as well as all rules or restrictions that are posted on the Service. These Terms are the standard terms for the provision of services by Hawkish Institutes and constitute a legally binding agreement between you and Hawkish Institutes. If you do not agree to these Terms, you are not authorized and must stop using the service immediately.

  • About Hawkish Institutes

Hawkish Institutes is an academic or educational organisation that offers professional, technology, vocational training, management and mentoring courses. These courses allow inexperienced people to become better and broaden their horizons by equipping them with professional and digital skills.

We achieve this through high-level physical training sessions and online certifications.

  • Eligibility

Our courses are only available to individuals who have the right and authority to enter into this Agreement, are fully able and competent to satisfy the terms, conditions, and obligations herein. By becoming a Learner, you represent and warrant that you are at least 18 years old and legally able to enter into a contract.

  • Course fees

Learners are required to pay the full fee in advance of the commencement of the course. The fees cover the certificate of completion which shall be issued by Hawkish Institutes upon successful completion of the course.

  • Payment/Billing

We use paystack to process payment for the course via our website. You may be asked to provide a credit or debit card number from a card issuer that we accept in order to activate your registration.

You hereby authorize Hawkish Institutes to charge your specified payment method, in advance for your selected course.

You hereby authorize the issuer of your selected payment method to pay any amounts described herein without requiring a signed receipt.

You agree to provide updated payment information upon request and any time the information you previously provided is no longer valid.

You acknowledge and agree that Hawkish Institutes, will not have any liability whatsoever for any charge incurred by you as a result of unsuccessful attempts to charge your specified payment method or as a result of extra charges incurred from your bank.

You agree to pay us, through our payment processors, Paystack, or any other payment processor which may from time to time be selected by us.

We accept all currencies that are receivable by our payment processor.

We reserve the right to correct, or to instruct our payment processor to correct, any errors or mistakes in the payment, even if payment has already been requested or received.

  • Cancellation/Modification

Our instructor-led virtual or physical courses require a minimum number of learners before courses can commence.

If the total number of registrations for the course falls below the minimum number required, we may cancel the course or extend the start date until the minimum number is achieved.

We reserve the right to modify or cancel courses, change the location or mode of delivery of our courses, or substitute instructors.

You will be notified of any cancellation of your selected course. Upon cancellation, you may select another course of your choice if available, or request a full refund.

Hawkish Institutes will not be liable for any losses incurred by you, or inconvenience occasioned to you, as a result of any modification or cancellation of courses.

A learner may express their interest to cancel their purchase of a course atleast two weeks prior to the course start date. This request should be sent via email to enquiries@hawkishinstitute.com. A refund, less administrative charges will be madeusing the original payment method within 14 days of the refund request being received.

No refunds will be issued for cancellation within two weeks of the course start date.

If you cannot attend your selected course on the start day due to extenuating circumstances such as sickness, you must contact us to notify us and we may allow you to transfer to another course cohort free of charge. We may ask you to provide us any documentation as proof of your circumstance.

No refund or transfer will be provided for not attending a course without prior discussion with, and approval, by us.

  • Termination

Where a payment plan is requested and accepted by us, we may cancel your registration for a course where you fail to fulfil the terms of the payment plan, and upon the cancellation, you will no longer have access to your selected course, until your payment of the remaining balance has been received by us.

Where payment is made after the end date of the course, the learner shall have no access to the course and all fees paid shall be non-refundable and non-transferable.

  • Start and End Dates

The official start and end dates for a course will be communicated to the learner prior to the start date.

  • Deferrals

Learners who wish to defer their start date for a course may, at the sole discretion of Hawkish Institutes, be allowed to do so provided there are extenuating circumstances and provided that the course fees have been fully paid and the course has not commenced.

Where the course has commenced, no leave of absence shall be permitted.

  • Refusal

Hawkish Institutes reserves the right to refuse course fees and to deny any applications for a course.

  • Force Majeure

We will not be liable for any delay or failure in performance or interruption of the delivery of our service resulting directly or indirectly from any cause or circumstances beyond our reasonable control including but not limited to failure of equipment or communication lines telephone or other interconnect problems computer viruses including logic bombs Trojan horses worms harmful components corrupted data or other malicious software or harmful data unauthorised access theft operator errors severe weather earthquakes or natural disasters strikes or other labour problems wars or governmental restrictions.

  • Governing Law and Jurisdiction

These Terms and Conditions, the Contract, and the relationship between you and Us (whether contractual or otherwise) shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria.

Any dispute, controversy, proceedings or claim between you and Us relating to these Terms (whether contractual or otherwise) shall be subject to the exclusive jurisdiction of the Nigerian Courts.

  • Entire Agreement

These Terms and any documents expressly incorporated by reference constitute the final, complete, and exclusive expression of the agreement between you and Hawkish Institutes regarding the Service provided under these Terms. Except as explicitly permitted in these Terms, no modification or amendment of these Terms shall be effective unless it is in writing and signed by the party against whom the modification or amendment is being asserted.

  • Waiver

The waiver by either you or Hawkish Institutes of any breach of any provision of these Terms does not waive any other breach. The failure of any party to these Terms to insist on strict performance of any covenant or obligation in accordance with these Terms will not be a waiver of such party’s right to demand strict compliance in the future, nor will the same be construed as a novation of these Terms.

  • Severability

If any part of these Terms is found to be illegal, unenforceable, or invalid in any respect, the remaining portions of these Terms will remain in full force and effect.

  • Interpretation

Any ambiguities in the interpretation of these Terms shall not be construed against the drafting party.

  • Headings

The headings used throughout these Terms are solely for the convenience of reference and are not to be used as an aid in the interpretation of these Terms.

  • Changes to the Terms

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms. The most current version of the Terms will be posted on our website and it is your responsibility to check our website periodically for changes. Your continued use of our Service following the effective date of any changes to these Terms constitutes acceptance of those changes. If you do not agree to the new Terms, you may not use the Service.
